Gregory Luce of the Adoptee Rights Law Center (a core partner of NYARC) has created this flowchart to demonstrate the simplicity of equality in New York. The new law is effective January 15, 2020.
If you are a descendant of a New York adoptee, use the flowchart as if you are the adopted person. You can also view a more interactive format of the flowchart here.

If you were adopted in Manhattan 1944 and want your obc, can you go in person on Jan 15th in Manhattan Clerks Office to get your birth record and how do you apply to the court or agency for your identifying info? The agency is saying identifying info is NOT applicable to this bill!

So since I was adopted I cant get my obc???? That’s what I’m reading. I was adopted on long island.

No. This is specifically for adoptees and their descendants. Were you born in New York? If yes, then you can. That’s it.

Hello, thank you for the informative flow chart. Are the courts aware that they are to release the identifying information and if so, how does one go about the request? This is for an adoptee who was born outside of NY but adopted in the state of NY either by an attorney or an agency.

It’s not yet fully determined how that part of the law will be implemented. We are waiting to get more details.

I feel this has been such an important law to be passed. I am very interested in getting medical records of my mother biological mother. Hopefully this will be a great 1st step.

Greetings, and thank you for all of the helpful resources on this well maintained site. This morning I filled out the online VitalChek form for my Pre-Adoption Birth Certificate, but did not submit it, only because it did not ask anywhere for my pre-adoption name. If they do not have that information, how will they know to send my pre-adoption-name certificate?

So far I have already hit a brick wall.I am an adoptee born in Buffalo,NY but raised in NYC.I was told by Vital Records earlier today that I need a birth parent name to apply for an OBC.All other info on myself was good.I don’t have her name yet,it’s frustrating.Can anyone guide me in the right direction?
